यूस्तिना वद्रिनिस्कालाई कुनै सहयोग वा भरपर्दो जानकारीको पहुँच बिना आफ्नै गर्भपतनको अनुभवले, प्रजनन् जीवनको बारेमा सुसूचित निर्णयहरू गर्न र अरूलाई सहयोग गर्न बल र प्रेरणा दियो। यूस्तिनाले युरोपमै सबैभन्दा प्रतिबन्धात्मक गर्भपतनसम्बन्धी कानुनहरू भएको पोल्याण्डमा गर्भपतनसँग सम्बन्धित लाञ्छना विरुद्ध अभियान गर्ने र सुरक्षित गर्भपतनमा पहुँच प्राप्त गर्न सल्लाह प्रदान गर्ने अभियानी समूह अबोर्सन ड्रिम टिम (Abortion Dream Team)को सह-स्थापना गरिन्।
सन् २०२० फेब्रुअरीमा यूस्तिनालाई आनिया (उनको वास्तविक नाम होइन) सँगको सम्पर्कमा ल्याइयो। आनिया एक दुर्व्यवहारयुक्त सम्बन्धमा थिइन्। उनी गर्भवती पनि थिइन् र हताशमा रहेकी थिइन्। आफ्नो गर्भावस्थालाई जारी राख्नु भन्दा बरू मर्न चाहेको कुरा उनले बताइन्। हिंसायुक्त सम्बन्ध भोगेर बाँचेकी यूस्तिनालाई आफूले मद्दत गर्नुपर्छ भन्ने थाहा थियो। उनले हुलाक मार्फत आनियालाई आफ्नै गर्भपतनको चक्की पठाइन, तर आनियाका साथी (partner) ले त्यो पोको फेला पारे र प्रहरीलाई सम्पर्क गरे। प्रहरीले सबै चक्कीहरू जफत पनि गर्यो।
सन् २०२१ नोभेम्बरमा सरकारी वकिलले यूस्तिना विरुद्ध “गर्भपतनमा सहयोग गरेको” मुद्दा दायर गरे। २०२३ मार्चमा उनी दोषी ठहरिइन् र आठ महिना सामुदायिक सेवा गर्नु पर्ने सजाय पाइन्। उनका वकिलले पुनरावेदन गरेका छन्।
यूस्तिनाको सजायले खतरनाक नजीर स्थापित गरेको छ। उनी र अन्य अभियानकर्ताहरूले उपलब्ध गराउने सहयोग र भरपर्दो जानकारी बिना आनिया जस्ता मानिसहरू एक्लो हुनेछन् र उनीहरूले सुरक्षित गर्भपतनमा पहुँच प्राप्त गर्ने छैनन्।
आफूले सामना गर्नुपरेको प्रतिरोधका बाबजुद पनि आफ्नो साहस देखाउँदै यूस्तिना यसो भन्छिन्: “कसैले सहयोग गर्न नचाहेको वा कसैले सहयोग गर्न नसक्ने अवस्थामा सहयोग गर्ने इच्छाशक्तिले म प्रेरित भएको हुँ। मेरो लागि आनियालाई सहयोग गर्नु एउटा स्पष्ट, सभ्य र इमानदार कर्म थियो।”
यूस्तिनाको अन्यायपूर्ण सजायलाई उल्टाउनका लागि आवश्यक सबै उपायहरू गर्न महाभियोजकसँग माग गरौं।
Prosecuted for defending safe abortion
Justyna Wydrzyńska’s own abortion experience, with no support or access to reliable information, gave her the strength and motivation to help others make informed decisions about their reproductive lives. Justyna co-founded Abortion Dream Team, an activist collective campaigning against abortion stigma and offering advice on accessing safe abortion in Poland, where abortion laws are among the most restrictive in Europe.
In February 2020, Justyna was put in contact with Ania (not her real name). Ania was in an abusive relationship, pregnant and desperate, saying she would rather die than continue with her pregnancy. Justyna, a survivor of a violent relationship herself, knew she had to help. She sent Ania her own abortion pills through the post, but Ania’s partner intercepted the package and contacted the police, who confiscated the pills.
In November 20212, the public prosecutor brought charges against Justyna for “helping with an abortion”. In March 2023, she was found guilty and sentenced to eight months’ community service. Her lawyers have appealed.
Justyna’s conviction sets a dangerous precedent. Without the support and trustworthy information that she and other activists provide, people like Ania would be alone and without access to safe abortion.
Demonstrating her courage in spite of the hostility she faces, Justyna says: “I was driven by the will to help when no one else wanted to or could help. For me, helping Ania was an obvious, decent, and honest thing to do.”
Demand the prosecutor general take all necessary measures to ensure that Justyna’s unjust conviction is overturned.
